Moody's updates on Dutch ABS and RMBS transactions originated by DSB Bank N.V. following court ruling on borrower compensation framework

London, 23 May 2014 -- On 13 May, the Amsterdam court passed an interim ruling on the framework agreement that sets out the compensation process on due care claims of clients of the now bankrupt DSB Bank N.V. (DSB). The court viewed the framework to be broadly adequate, but raised concerns about some aspects of the framework that apply to certain types of claims and suggested that improvements are made. Although the bankruptcy trustees must still carry out a full assessment of the impact of the court's suggested improvements on the potential compensation amounts, the suggested improvements would apply to only a limited number of borrowers and/or result in an only moderate increase in the compensation amounts.
