Ron Simon & Associates Files Salmonella Lawsuit Against the Boise Co-Op As Statute of Limitations Approaches

BOISE, Idaho, May 16, 2017 /PRNewswire/ -- Today the national food safety law firm of Ron Simon & Associates, along with co-counsel Peterson Lawyers, filed a lawsuit stemming from salmonella-contaminated food served by Boise Co-Op located at 888 West Fort Street in Boise, Idaho.

The lawsuit was filed in Ada County, Idaho, on behalf of Idaho residents Michael Pendergraft and Taylor Wallace, and Albuquerque resident Kimberly O'Roark

In early June of 2015, Pendergraft and Wallace consumed sandwiches from the Boise Co-Op, while O'Roark purchased a Boise Co-Op sandwich sold at the Paradise Airport Shops at the Boise Airport.  All three became ill with Salmonella poisoning within the next 24 hours, and were compelled to seek extensive medical treatment. 

The Idaho Department of Health subsequently confirmed that all three were positive for the outbreak strain of Salmonella Enteritidis, identifying them as confirmed victims in the Boise Co-Op Outbreak of 2015.

Pendergraft and O'Roark are still recovering from complications of salmonella poisoning, which can have serious long-term health implications. 

Boise Co-Op – At Least 294 Salmonella Victims

Between June 1st and 10th of 2015, many of the patrons of Boise Co-Op, both at the main deli located at 888 West Fort Street and also those who purchased food at airport kiosks, were exposed to salmonella bacteria in products they purchased. Based upon the eating histories of interviewed victims, the Central District Health Department (CDHD) sent investigators to the Boise Co-Op and took samples for bacterial culturing.  On June 15th, laboratory testing confirmed salmonella contamination on at least three different food products, including onions, tomatoes, and turkey meat.

The restaurant was closed during the investigation.  During the closure, the Boise Co-Op installed new hand sinks and implemented policies preventing sick employees from working.  Health officials identified at least 294 individual salmonella victims associated with the outbreak.

Under the Idaho statute of limitations, there are only a few weeks left for victims in this outbreak to preserve any legal claims they might have related to acquiring salmonella poisoning as a result of the Boise Co-Op Outbreak of 2015.
