Metrologic Receives Interim Ruling in Arbitration With Symbol Technologies

    BLACKWOOD, N.J.--(BUSINESS WIRE)--May 16, 2005--Metrologic Instruments, Inc. (NASDAQ-NMS:MTLG), experts in optical image capture and processing solutions, who design, manufacture and market worldwide sophisticated imaging and bar code scanning solutions for a variety of applications, today announced it has received an interim ruling from the arbitrator in its ongoing arbitration proceedings with Symbol Technologies, Inc. (NYSE-SBL).
    Earlier this year, the Company had requested a review of a portion of the previously announced ruling which found that certain of its products fell within the scope of the parties' existing license agreement. Today's ruling is the result of that review and confirmed the arbitrator's earlier finding that the MS9520 scanner is within the scope of the existing license. The interim ruling was limited to this issue and does not affect the arbitrator's earlier ruling in favor of Metrologic on eight of the eleven products involved. This decision does not address any claim for damages and is not a final award in this proceeding.
    The Company remains firm in its belief that the arbitrator's rulings in this matter are in direct contradiction with earlier rulings by the U.S. District Court for the Eastern District of New York and the Court of Appeals for the Second Circuit in the lawsuit commenced by Symbol concerning these same products where a final judgment was entered in favor of Metrologic. Metrologic does not believe this ruling by the arbitrator has changed this position and will continue its vigorous defense of these claims.
