McKool Smith's Robin Cohen Recognized as an "Insurance MVP" by Law360

NEW YORK, Nov. 30, 2016 /PRNewswire/ -- McKool Smith principal Robin Cohen has been recognized as an "Insurance MVP" by Law360. As reported by Law360, the September 2016decision "reversed a lower court decision, finding that coverage was triggered if any bodily injury incurred during the insurers' policy periods, as opposed to significant exposure to asbestos," and entitles Warren to access hundreds of millions of dollars in insurance coverage for their asbestos-related liabilities. The ruling followed an earlier landmark decision that Robin secured as lead counsel for Warren Pumps before New York's highest court, the Court of Appeals, on an issue of first impression in New York. The decision held that standard form insurance policies containing "non-cumulation provisions" or "prior insurance provisions" allow a policyholder to obtain coverage for its full liability from policies covering any policy year in which some injury took place. Since the decision interprets standard-form language, it has broad, multi-billion dollar implications for coverage nationwide. The ruling topped Law360's report on the "Biggest Insurance Rulings So Far In 2016."

Robin also led McKool Smith's team in securing a preliminary injunction against Lloyd's of London and Axis Specialty Europe SE in April 2016, which ordered the immediate reimbursement and advancement of defense costs incurred by her client, former FIFA official Eduardo Li, who was indicted in a criminal action. The decision affirms a policyholder's right to injunctive relief and recognizes the federal court's obligation to protect criminal defense counsel by ensuring they are properly compensated by insurance.
