ICTS International N.V. Reports Favorable Court Decision For Huntleigh

AMSTELVEEN, Netherlands--(BUSINESS WIRE)--April 28, 2005--ICTS International N.V. (NASDAQ:ICTS), today reported another court victory for its wholly-owned subsidiary, Huntleigh USA Corporation, in Huntleigh's lawsuit against the federal government alleging a violation of the Takings Clause of the Fifth Amendment. On January 7, 2005, the United States Court of Federal Claims issued an opinion denying the government's motion to dismiss the action. The government, recognizing the import of the opinion which allowed Huntleigh's claims to proceed, sought to reargue the motion to dismiss and asked the Court to reconsider its position. Last week, the Court denied the government's motion to reconsider the January 7 opinion.
Huntleigh's lawsuit alleges that Huntleigh's airport security screening business was destroyed when the government federalized security at all domestic airports in the wake of September 11. The action also claims that the United States violated sections of the Aviation Transportation and Security Act when it did not pay adequate compensation for the loss of Huntleigh's private screening contracts. In the Court's recent opinion denying the government's motion for reconsideration, the Court stated that the government had failed to meet the standards to prevail on its motion and reaffirmed the holdings in its January 7 opinion. Menachem Atzmon, the Chairman of ICTS's Supervisory Board, remarked that the Court's opinion "clears the way for Huntleigh to establish the validity of its Takings claim."
