Each year, businesses are challenged with the task of keeping abreast with the latest happenings of employment law. Here are five areas to keep an eye on.
Health care law. Proposed changes to the Affordable Health Care Act are at the top of the list of laws to watch. Legislation is constantly changing, and it is vital businesses remain compliant with all aspects of the ACA, such as tax provisions and employee health care coverage. The Obamacare individual mandate has been repealed.
Wage/hour law. The Trump administration may be making changes to the previous administration's regulation, which aimed to increase the salary thresholds for specific exempt employees to $913 a week. The Department of Labor will reach out to the public before a revised proposed overtime rule is established.
Social media in the workplace. This is a hot topic, in and out of the workplace, for employees, particularly the younger generations. It is becoming increasingly difficult to monitor as more and more businesses employ social media to market and promote themselves. Therefore, it is imperative that employers develop a concise social media policy and educate their employees with best practices for interacting on social media platforms.
Sexual harassment. This issue has come to the forefront in recent months. Employers must take the lead in reviewing their sexual harassment policies to not only ensure they are in compliance with current laws, but also to protect employees. Then, they must offer mandatory training to each employee, and follow up. Include concrete examples of behaviors to avoid, and make sure employees who file a complaint know they will be protected.
Compliance with pay statements. Currently, Congress is taking into account mandating pay statements to show employee data, including the method in which the pay is calculated, available leave time, and overtime compensation. Companies must also pay attention to how they would present wage information is statements for different types of employees. For example, salaried employees versus employees paid hourly, or whether or not employees are exempt from overtime.
