mybet Holding SE: German Federal Supreme Court refers Westlotto proceedings back to Higher Regional Court of Düsseldorf

Kiel, July 12, 2016. Today the Cartel Panel of the German Federal Supreme Court decided to set aside the judgement of the Higher Regional Court of Düsseldorf and referred the proceedings back to the Higher Regional Court. According to the Federal Supreme Court, the claimed cartel infringement is beyond any doubt. But the Higher Regional Court of Düsseldorf had not taken into account all important circumstances when calculating the actual damage. The reasons of the Federal Supreme Court for the decision in the appeal proceedings SWS Service GmbH / Westdeutsche Lotterie GmbH & Co. OHG (BGH KZR 25/14) were not available yet.
