Card Activation Receives Notice from Patent Office Regarding Reexamination Proceeding

Card Activation Technologies (Pink Sheets: CDVT) announced that on June 23, 2010, the United States Patent and Trademark Office issued a "Notice of Intent to Issue Reexamination Certificate” ("Notice”) in the reexamination proceeding involving Card Activation Technologies’ ("Card”) U.S. Patent number 6,032,859, covering the processing of debit purchase transactions such as purchases using gift cards. The Notice confirms the Patent Office’s finding of patentable claims in the proceeding and its intent to issue a Reexamination Certificate confirming the patentability of those claims.

Card is actively enforcing the ‘859 Patent against infringing retailers in multiple, ongoing lawsuits, and has entered into licensing agreements with numerous other retailers. Bob Kite, CEO of Card, stated, "The Notice not only confirms the patentability of the claims, it strengthens the ‘859 patent in view of the additional prior art considered by the Patent Office during the reexamination proceeding.” With the favorable reexamination and the favorable claim construction recently entered in the ongoing litigation in Delaware, Card intends to continue to vigorously enforce its rights under the patent and seek licensing agreements with infringing retailers.
